And so that’s how we have been able to authorize some tobacco-flavored e-cigarettes for marketing. This is because under federal law, although the FDA has the power to regulate the tobacco industry, they can do so with certain limitations. Because most tobacco use starts during adolescence, actions to protect our nation’s young people from a lifetime of nicotine addiction are critical. The present trial suggests that they are, but it does not provide a definitive answer. Although only minimal behavioral support was included, smokers were still asked to set up a TQD and their smoking status was checked monthly, features that are not available to smokers using ECs on their own. To see whether public health messages on EC use for smoking cessation need to include advice to use any additional support, further studies are needed that compare effects of different levels of behavioral support added to ECs. The heating element vaporizes the e-liquid stored in the cartridge and releases an aerosol or vapor, which the user inhales. Extended EC use may be beneficial for some previous smokers by helping them to maintain some of the subjective rewards of smoking, avoid postcessation weight gain, or prevent relapse. In December 2019, Congress raised the minimum age to buy tobacco products, including e-cigarettes, from 18 to 21. Because of the popularity of certain flavored e-cigarette products among children, FDA stated in January 2020 that it would prioritize enforcement actions against the manufacture and sale of most flavors in cartridge-based e-cigarettes. In April 2020, FDA extended from May to September 2020 the deadline for manufacturers to apply for premarket authorization, a process that includes the scientific evaluation of risks and benefits of e-cigarettes for the U.S. population. In 2019, the MCIAA was amended to expand the definition of smoking to include electronic delivery devices, also known as e-cigarettes or vapes.
