FTC Issues Third Report on E-Cigarette Advertising and Sales in the U S. Federal Trade Commission

Both increased markers of oxidative stress and decreased NO bioavailability, flow-mediated dilation, and vitamin E levels showing no significant differences between tobacco and e-cigarette exposure (reviewed in [20]). Inasmuch, short-term e-cigarette use in healthy smokers resulted in marked impairment of endothelial function and an increase in arterial stiffness (reviewed in [20]). Similar effects on endothelial dysfunction and arterial stiffness were found in animals when they were exposed to e-cigarette vapor either for several days or chronically (reviewed in [20]). In contrast, other studies found acute microvascular endothelial dysfunction, increased oxidative stress and arterial stiffness in smokers after exposure to e-cigarettes with nicotine, but not after e-cigarettes without nicotine (reviewed in [20]). In women smokers, a study found a significant difference in stiffness after smoking just one tobacco cigarette, but not after use of e-cigarettes (reviewed in [20]). One of the first studies in humans involved the analysis of 9 volunteers that consumed e-cigarettes, with or without nicotine, in a ventilated room for 2 h [8].

The majority of respondents currently smoked cigarettes either daily (30.9%) or weekly (44.4%). Most respondents had been aware of the ban before the survey (67.7%), with a plurality feeling neutral about the ban (36.1%) but more supporting the ban than opposing it (35.9% vs. 28.1%). Among respondents who knew about the ban before the survey, the perceived compliance of local retailers with the ban as lower than 50% was quite high (66.2%), and relatively few perceived that more than 75% of retailers were complying (14.8%). On Dec. 21, 2022, California enacted Senate Bill 793, which prohibited the sale of most flavored tobacco products, including e-cigarettes, to people of all ages. Hookahs, premium cigars and loose-leaf tobacco were exempted from the legislation.

Urgent measures are necessary to prevent uptake of e-cigarettes and counter nicotine addiction alongside a comprehensive approach to tobacco control, and in light of national circumstances. While nicotine is the addictive substance in cigarettes, most of the harm from smoking comes from the thousands of other chemicals in tobacco smoke, many of which are toxic. Under the PACT Act, delivery sales of electronic nicotine delivery systems must also comply with state, local or tribal laws involving excise taxes on these devices. Further, in 2018, one in 15 (6.7%) middle school students reported using e-cigarettes.

Using e-cigarettes, or “vaping,” are terms used synonymously to refer to the use of a wide variety of electronic, battery-operated devices that aerosolize, but do not burn, liquids to release nicotine and other substances. Nicotine-containing e-cigarettes are regulated as “tobacco products” by the FDA because the nicotine is derived from the tobacco plant. E-cigarettes pose a threat to the health of users and the harms are becoming increasingly apparent. In the past few years, the use of these products has increased at an alarming rate among young people in significant part because the newest, re-engineered generation of e-cigarettes more effectively delivers large amounts of nicotine to the brain. Many e-cigarettes sold in the U.S. contain far more nicotine than e-cigarettes sold elsewhere, which increases the risk of addiction and harm to the developing brains of youth and young adults. Marketing tactics targeting young people have contributed to the rapid increase in use.

Side effects are usually easily managed and should not stop you from vaping as a way to quit smoking. Most of the harmful chemicals in tobacco smoke, including tar and carbon monoxide, are not contained in vape aerosol. Evidence shows that vaping is substantially less harmful than smoking. Vaping exposes users to far fewer toxins and at lower levels than smoking cigarettes. You’re roughly twice as likely to quit smoking if you use a nicotine vape compared with other nicotine replacement products, like patches or gum. The routines and rituals of smoking can be hard to stop, so vaping can help you gradually let go of these while immediately reducing the health risks of smoking cigarettes.

“We still do not understand the consequences of chronic e-cigarette vaping,” he says. In 2018, the FDA warned of an epidemic of teens who were becoming addicted to nicotine through these products. Among the flavouring chemicals tested, CAD was found to be the most toxic and O-vanillin and pentanedione also showed significant cytotoxicity; by contrast, acetoin, diacetyl, maltol, and coumarin did not show any toxicity at the concentrations assayed (10–1000 µM). Of interest, a higher toxicity was evident when combinations of different flavours or mixed equal proportions of e-liquids from 10 differently flavoured e-liquids were tested, suggesting that vaping a single flavour is less toxic than inhaling mixed flavours [86]. Also, all the tested flavours produced significant levels of ROS in a cell-free ROS production assay.

The Food and Drug Administration (FDA) extended its regulatory authority over tobacco products to include e-cigarettes in May 2016. In December 2019, Congress raised the minimum age to buy tobacco products, including e-cigarettes, from 18 to 21. Because of the popularity of certain flavored e-cigarette products among children, FDA stated in January 2020 that it would prioritize enforcement actions against the manufacture and sale of most flavors in cartridge-based e-cigarettes. In April 2020, FDA extended from May to September 2020 the deadline for manufacturers to apply for premarket authorization, a process that includes the scientific evaluation of risks and benefits of e-cigarettes for the U.S. population. In 2019, the MCIAA was amended to expand the definition of smoking to include electronic delivery devices, also known as e-cigarettes or vapes. The amendment protects employees and the general public from hazards to secondhand smoke and involuntary exposure to aerosol or vapor from e-cigarettes.

And to fast forward to today, we have taken final action, one way or the other, on more than 6.6 million of the almost 6.7 million products that were the subject of timely submitted applications. Roy S. Herbst, MD, PhD, deputy director for clinical affairs and chief of medical oncology at Yale Cancer Center and Smilow Cancer Hospital, says he would like to see more clinical trials on this subject. “Ideally, we would encourage someone who is already smoking to switch to e-cigarettes,” Dr. Herbst says. The order only applied to pods that go in refillable cartridge-based devices, and not to disposable e-cigarettes. Unlike e-cigarette devices that come with a spot to place a cartridge, disposable e-cigarettes contain everything in one unit. The study, published on May 23, 2022, in Tobacco Control, is the first to look at the health care costs of e-cigarette use among adults 18 and older.

A survey by the WHO and the health ministry on students in 11 localities revealed that the rate of using e-cigarettes among students has been consistently rising among certain age groups. They are addictive as they contain nicotine, can cause diseases like cancer, and affect one’s mental health. With the menthol cigarette ban uncertain, the path for low-risk tobacco product authorization needs to be reimagined to nationally increase MRTP availability, access, and appeal among people who use menthol cigarettes. For example, one study among people who smoke showed that hypothetical general claims about completely switching to a heated tobacco MRTP outperformed specific claims—such as switching from cigarettes will reduce the risk of lung cancer and exposure to arsenic.

That’s not to say that e-cigarettes haven’t helped some people transition away from conventional cigarettes. Still, it’s far from safe and can lead to nicotine addiction and potentially fatal lung disease. Electronic cigarettes—or e-cigarettes—are battery-powered devices that convert a liquid, usually with nicotine, into an inhalable aerosol. They are designed as an alternative to smoking traditional cigarettes. First introduced in the United States about 15 years ago, e-cigarettes have evolved from disposable, single-use products to more sophisticated devices that can be refilled and customized (fig. 1). One of the largest studies done on this was published in The New England Journal of Medicine in 2019. The study, which included 886 randomized participants, compared e-cigarettes and nicotine replacement therapy, which included patches, gum, lozenges, nasal spray, and mouth spray.

Treatment included weekly behavioral support for at least four weeks. The one-year abstinence rate was 18% in the e-cigarette group and 9.9% in the nicotine replacement group. To date, there is no state excise or special tax placed on e-cigarettes.

Finally, we estimated the age-standardized prevalence of e-cigarette use by state, allowing for comparisons while adjusting for variations in age distribution. Chronic health conditions assessed included cardiovascular disease, diabetes, cancer (excluding skin cancer), chronic obstructive pulmonary disease (yes or no), and depression (yes or no). Cardiovascular disease was defined as a composite of myocardial infarction, coronary heart disease, or stroke. Both middle and high school students use e-cigarettes more than any other tobacco product. U.S. middle and high school students use e-cigarettes more than any other tobacco product. The dangers of vaping include lung and other organ damage, breathing problems, addiction and more.

Because e-cigarettes contain nicotine derived from tobacco, they are now subject to government regulation as tobacco products. In December 2019, the federal government raised the legal minimum age of sale of tobacco products from 18 to 21 years, and in January 2020, the FDA issued a policy on the sale of flavored vaping cartridges. Products marketed for therapeutic purposes (for example, marketed as a product to help people quit smoking) are regulated by FDA’s Center for Drug Evaluation and Research (CDER). FDA published a rule clarifying when products made or derived from tobacco are regulated as tobacco products, drugs, and/ or devices.

E-cigarette companies have promoted unsubstantiated health claims about their products as healthier than traditional cigarettes, when, in fact, e-cigarettes are uniquely dangerous for kids due to nicotine’s impact on their developing brains. This cross-sectional study highlights a high prevalence of e-cigarette use among adults in the US, particularly among young adults, in 2021. A striking finding is that 71.5% of those aged 18 to 20 years who reported e-cigarette use had no prior history of combustible cigarette use—this number is numerically higher compared with prior BRFSS data.

This does not necessarily mean, however, that e-cigarettes are free from hazardous effects. Indeed, studies investigating their long-term effects on human health are urgently required. Youth and young adults had more than three times the odds of using fruit-flavored e-cigarettes compared to older adults. A 2017 study by Truth Initiative found 25% of survey respondents, aged 15-24, recognized a JUUL e-cigarette device when shown a photo of the product. And among those who recognized JUUL, 25% reported that use of this product is called “JUULing,” indicating that this product is so distinctive, it’s perceived as its own category. However, it’s likely that recognition is higher now given that JUUL’s sales market share continued to rise throughout 2018 and top out at 75% among U.S. e-cigarette sales in July 2019. With Americans puffing less each year, the cigarette industry sees ESDs and other smokeless products as financial saviors.

E-cigarettes are nicotine-based products, and no nicotine use is safe. Until we know more, it is probably best to avoid these products whenever possible, including secondhand smoke. However, vaping early on may increase the chances of smoking ordinary cigarettes later in life.

In 2018, the rapid rise of tobacco products led the U.S. surgeon general to issue an advisory about the youth e-cigarette “epidemic.” In 2019, youth e-cigarette use increased to even higher levels.
